MVP Testing Phase

These Terms & Conditions ("Terms") govern your access to and use of the Wellzy Health mobile application and website (wellzyhealth.ai), operated by Wellzy Health ("Provider," "we," or "us"). By creating an account and checking the acceptance box during registration, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.
These Terms apply to the MVP (Minimum Viable Product) testing phase. Features, AI outputs, and data practices may change materially before public release.
1. MVP Testing & As-Is Service
You acknowledge that Wellzy Health is currently in an early MVP testing phase. The AI-generated meal plans, exercise plans, food photo analysis, habit coaching, and behavioral feedback are provided strictly on an "as-is" and "as-available" basis.
We make no warranties or guarantees — express or implied — regarding the accuracy, reliability, completeness, or fitness for a particular purpose of any AI output. The app may be modified, suspended, or discontinued at any time without prior notice during the MVP phase.
2. Medical Disclaimer (General Wellness Only)
Wellzy Health is a general wellness and lifestyle application. It is not a medical device. AI-generated meal plans, exercise plans, habit-forming guidance, and behavioral coaching are for educational and informational purposes only. They do not constitute professional medical advice, diagnosis, or treatment.
You should never disregard or delay seeking professional medical advice based on content in this app. If you have any medical conditions, metabolic disorders, eating disorders, cardiovascular conditions, musculoskeletal injuries, or other health concerns, consult a qualified healthcare professional before making any changes.
3. Eligibility
You must be at least 18 years of age to use this service. By using the app, you represent and warrant that you meet this requirement. Users under 18 may only participate with the express consent of a parent or legal guardian, who assumes full responsibility for supervising all use of the app and any resulting lifestyle changes.
4. Data & Privacy
By using Wellzy Health, you consent to the collection and processing of personal data, including health-related information and food photographs, as described in our Privacy Policy. Specifically:
• Your data is used to operate, personalize, and improve the AI meal planning and coaching experience.
• During the MVP phase, data may be reviewed by the Wellzy team for quality assurance and product improvement purposes.
• Data may be processed by third-party AI infrastructure providers under appropriate data processing agreements.
• You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us at privacy@wellzyhealth.ai.
• Data retention during the MVP phase: your data will be retained for the duration of the testing period and deleted or anonymized within 90 days of the MVP phase conclusion, unless you continue as a registered user.

5. Assumption of Risk
You voluntarily assume all risks associated with following AI-generated meal plans, exercise plans, habit-forming programs, and health tips provided by the app. These risks include, but are not limited to, allergic reactions, nutritional imbalance, physical injury, muscle strain, and cardiovascular events.
You agree to stop any dietary or exercise activity immediately if you experience adverse symptoms, and to seek appropriate medical attention. Wellzy Health assumes no responsibility for any health outcomes, adverse reactions, physical injury, or damages resulting from your use of the service.
6. Intellectual Property
All content, branding, software, and design elements of Wellzy Health are the property of the Provider and are protected by applicable intellectual property laws. You may not copy, reproduce, reverse engineer, or create derivative works from any part of the app without prior written consent.
AI-generated content (meal plans, exercise plans, coaching tips) delivered to you is licensed for your personal, non-commercial use only. You may not resell, redistribute, or commercialize this content.
Content you submit to the app (food photos, personal inputs) remains yours. By submitting it, you grant Wellzy Health a non-exclusive, royalty-free license to use it solely for operating and improving the service.
7. Prohibited Use
You agree not to:
• Use the app for any unlawful purpose or in violation of these Terms.
• Attempt to reverse engineer, decompile, or extract the app's source code or AI models.
• Submit false, misleading, or harmful content to the AI system.
• Share your account access with any third party.
• Use the app in any way that could damage, disable, or impair its infrastructure.
8. Termination
We reserve the right to suspend or terminate your access to the app at any time during the MVP phase, with or without notice, for any reason including breach of these Terms, end of the testing period, or discontinuation of the service. Upon termination, your right to use the app ceases immediately.
9. Changes to These Terms
We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this document and notify you via in-app notification or email. Your continued use of the app after such notification constitutes your acceptance of the revised Terms.
10. Maximum Liability Cap
To the maximum extent permitted by applicable law, Wellzy Health's aggregate liability for any claims, damages, or injuries arising from your use of the app shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim, or (b) $1.00 USD.
In no event shall Wellzy Health be liable for indirect, incidental, special, consequential, or punitive damages.
For free MVP users, this cap is effectively $1.00 USD — the legal minimum to maintain enforceability in most jurisdictions.
11. No Emergency Services
Wellzy Health is not an emergency service. In the event of a medical emergency, call your local emergency number (such as 911, 101, or 112) or go to the nearest emergency room immediately. Do not rely on this app in urgent medical situations.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any legal disputes arising from use of the app shall be resolved exclusively in the competent courts of Israel.
